Terms and Conditions – List with Claire to win $1000 Prezzy Card. 

1. This Competition (Competition) is conducted by Claire Campbell of Mike Pero Real Estate Invercargill of 159 Spey Street, Invercargill (Promoter).
2. This Competition begins at 9:00am on Sunday 1 October 2023 and closes at 5:00pm on Friday 8 December 2023 (NZDT) (Promotion Period).
3. This Competition is open to individuals who:
   1. are New Zealand residents;
   2. are aged 18 years or older; and
   3. have not breached these Terms and Conditions.
4. Employees (and their immediate families) of the Promoter or its related entities are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. Related entity means related within the meaning of the Companies Act 1993.

How to Enter

5. To be eligible, individuals must:
   1. list their property with an exclusive agency agreement with the Promoter during the Promotion Period; and
   2. not withdraw from or cancel the agency agreement for any reason.
6. All eligible individuals will automatically be entered into the Competition.
7. One entry per eligible individual and property only.
8. If you wish not to enter the Competition, you may request your withdrawal directly with the Promoter.

The Prize

9. The prize is one $1000 Prezzy Card.
10. The prize (or any unused portion of the prize) is not transferable, exchangeable or redeemable for cash. The prize must be taken as offered and may not be varied.
11. The Promoter, in its discretion, reserves the right to substitute the prize with another prize to the equal value and/or specification if the prize is unavailable, or subject to any requests from a regulatory authority.
12. The winner is responsible for understanding and complying with their taxation obligations in relation to the prize.
13. By entering this Competition, entrants agree they will take all reasonable steps requested by the Promoter to enable delivery of the prize.

Prize Draw and Winner Notification

14. The winner will be randomly selected by the Promoter from all entries received during the Competition Period.
15. The Promoter shall notify the winner by telephone by 5:00pm on Saturday 9 December 2023 and may publish the winner’s first name/s on the Promoter’s Facebook and Instagram pages.
16. If the winner has not accepted the prize by 5:00pm on 15 December 2023, the prize is forfeited, and a new winner will be randomly selected and contacted in accordance with clause 15.

Privacy

17. When the entrant enters this competition, the Promoter may collect the personal information the entrant provides. If the entrant wins the Competition, the Promoter may collect further information about the entrant.
18. By accepting the prize, winners consent to the Promoter and Mike Pero (New Zealand) Ltd and its related companies using their name, and image in the event they are the winner (including photograph) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. The Promoter may disclose the entrant’s personal information to:
    1. Entities who assist the Promoter in administering the Giveaway and fulfilling the prize, and other prize suppliers and deliverers;
    2. Marketing, research, and communications agencies;
    3. Its related companies, who will use and disclose it for similar purposes as the Promoter’s
    4. The authorities responsible for the regulation of gaming and lotteries and other government agencies, where applicable; and
    5. Other parties where required by law.
20. The Promoter will not disclose the entrant’s information overseas in the course of the competition.
21. The Promoter and its related companies will manage the entrant’s information in accordance with the Mike Pero Real Estate Privacy Policy.  This explains how to request access to and correct or update information we hold about you, how to raise a complaint about privacy and how we will deal with your complaint.

Miscellaneous Provisions

23. Participation in this Competition is acceptance of these Terms and Conditions.
24. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.
25. Each entrant acknowledges that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of an entrant’s ineligibility to enter after the Promoter has awarded a Prize to the ineligible entrant.
26. Return of a Prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.
27. If for any reason this Competition is not capable of running as planned for any reason, including without limitation technical failure, tampering, unauthorized intervention, fraud, or any other matter beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition or the reputation of this Competition or that of the Promoter, the Promoter may cancel, terminate, modify or suspend this Competition.
28. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including their eligibility to enter) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions, who interferes improperly in the administration, integrity or conduct of the Competition or who otherwise tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided by law.
30. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of participation in the Competition including without limitation:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any tax liability incurred by a winning entrant; or
    5. acceptance or use of a prize.
31. The laws of New Zealand apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New Zealand.
32. The Promoter’s decisions in relation to this Competition are final and no correspondence or communication will be entered into in relation to any aspect of this Competition.
